Terms of Service

These terms apply to refitplatform.com and the Refit platform, including any web applications, mobile applications and marketplace integrations operated by Refit. The current website is primarily informational; the sections below describe both your use of the website today and the terms that govern the Refit platform.

By using refitplatform.com you agree to these terms as they apply to the website. These terms also govern use of the Refit platform when users create an account, connect a marketplace or otherwise access the service. Submitting a contact or partner enquiry form does not create a software account or any obligation to provide the platform. If you use Refit on behalf of a business, you confirm that you have authority to bind that business to these terms.

Refit is software that transforms seller inputs — photographs, notes and product details — into structured product data and publication-ready listings for supported marketplaces. Refit structures and enhances listing information but does not determine pricing, ownership or commercial terms between buyers and sellers. Refit enhances photography and organises information; it does not alter, inspect or authenticate physical garments, and it does not take ownership of inventory or act as a party to any sale. These capabilities are delivered through the Refit platform and are not offered through this website.

For accounts created through the Refit platform:

• You must provide accurate account information and keep it up to date.
• You will be responsible for safeguarding your credentials and for activity that occurs under your account.
• Accounts are for business use by the organisation that registered them and may not be shared with unauthorised parties.
• You must notify us promptly of any suspected unauthorised access.

Marketplace integrations are established through the Refit platform using each marketplace's official authorisation process. Refit will act only within the permissions granted and only to perform actions the user requests.

• Users remain responsible for compliance with the terms, policies and listing rules of each marketplace they use.
• Marketplaces may change, limit or withdraw their APIs, which can affect Refit functionality.
• Authorisations granted to Refit can be revoked at any time.
• Refit is an independent platform and is not endorsed by or affiliated with any marketplace unless expressly stated.

• Do not use Refit to list counterfeit, stolen, prohibited or misrepresented goods.
• Do not upload content you do not have the rights to use.
• Do not attempt to disrupt, reverse engineer, scrape or gain unauthorised access to the platform or its infrastructure.
• Do not use the platform to violate applicable law or the policies of a connected marketplace.
• Do not misuse generated content in a way that misleads buyers about the condition or nature of an item.

Refit and all associated software, models, interfaces and branding remain our property. Users will retain ownership of the product content they upload, including photographs and item details, and will grant Refit a limited licence to process that content in order to provide the service, including generating enhanced imagery, structured data and listing drafts, which they are free to use commercially.

We aim to provide a reliable service but do not guarantee uninterrupted availability of the website or the platform. Access may be affected by maintenance, third-party outages, marketplace API changes, or circumstances outside our control. Features will evolve as the platform develops.

To the maximum extent permitted by law, Refit is provided "as is" and we are not liable for indirect, incidental or consequential loss, including lost sales, lost profits or lost data. Nothing in these terms limits rights that cannot be excluded under the Australian Consumer Law or other applicable law.

You may stop using the website or the Refit platform at any time, and close any account you hold. We may suspend or terminate access where these terms are breached, where use creates risk for the platform or a connected marketplace, or where required by law. On termination, marketplace authorisations will be revoked and data will be deleted or retained only as described in our Privacy Policy.

These terms are governed by the laws of Western Australia, Australia, and the courts of that jurisdiction have non-exclusive jurisdiction over any dispute.
